The agency of girl group FIFTY FIFTY, Attrakt, has lost its appeal in the copyright dispute over the hit song “Cupid.”
According to legal sources on March 5, the Seoul Central District Court Civil Division 5-2 held the appeal verdict hearing for the copyright confirmation lawsuit filed by Attrakt against The Givers. The court dismissed Attrakt’s appeal, upholding the earlier decision from the first trial.
Attrakt originally filed the lawsuit in 2024, arguing that the copyright property rights for “Cupid” belonged to the company and requesting that the rights be transferred from The Givers.
However, during the first trial in May of last year, the court ruled that “the plaintiff’s claims have no grounds and are therefore dismissed.”
The court determined that The Givers was the party directly involved in the copyright transfer agreement, including contract negotiations, signing, and covering related costs.
The court also emphasized that contracts must be interpreted according to the written terms rather than personal intentions, concluding that The Givers clearly holds the rights related to the song’s creation.
After the ruling, Attrakt filed an appeal, but the court has now dismissed the claim again in the second trial, maintaining the previous judgment.
Meanwhile, in a separate case earlier this year, Attrakt partially won a damages lawsuit filed against The Givers in January.
