FIFTY FIFTY’s agency loses ‘Cupid’ rights case as court sides with The Givers — only Kina has returned to the group
The agency behind FIFTY FIFTY is facing major trouble after losing its legal battle over the copyright of the hit song “Cupid.”
On May 9, the Seoul Central District Court officially dismissed the lawsuit filed by Attract, the agency of FIFTY FIFTY. The court ruled in favor of The Givers, the production company that helped create “Cupid,” saying Attract had no legal claim to the copyright.
Attract had filed the lawsuit last year, arguing that the rights to “Cupid” belonged to them and should be transferred from The Givers. However, the court decided that The Givers were the rightful holders of the song’s economic rights — which includes using the song commercially and giving permission for its use.
The judge explained that The Givers handled all negotiations, payments, and contracts involved in making the song. The court also found no written proof in the contract that said The Givers were supposed to give those rights to Attract.
Attract also tried to claim co-ownership of the song or demand other rights, but the court rejected those too, stating that The Givers took all the risks and made creative decisions on their own.
“Cupid” made a big splash after its release in 2023, becoming a viral hit and even making it to No. 17 on the Billboard Hot 100, an impressive achievement for a rookie girl group.
But behind the success, tensions were rising. The members of FIFTY FIFTY filed injunctions to suspend their contracts with Attract, leading to a long legal mess. Eventually, only Kina withdrew her complaint and returned to the group.
Since then, Attract has announced plans to reorganize FIFTY FIFTY as a five-member group, but with the copyright case loss and only one original member remaining, fans are left wondering what the future holds.
Do you think FIFTY FIFTY can make a strong comeback after all this drama?
